Welcome to Fife Fruit Trees. These Terms of Service ("Terms") govern your use of our website and the purchase of any products from us. By placing an order with Fife Fruit Trees, you agree to be bound by these Terms.

  • Territory: We can deliver trees to UK addresses, but regret that due to Brexit we cannot ship trees to Northern Ireland

2. Product Availability & Seasonal Operations

  • Dormant Season Dispatch: Bareroot trees are living plants that can only be lifted, dispatched, and planted during their natural dormant season, which runs strictly from mid-November to mid-March.

  • Pre-Orders: Orders placed outside the dormant season are treated as pre-orders and will be dispatched during the next available winter shipping window (mid-November to mid-March).

  • Stock Availability: All orders are subject to stock availability and weather conditions. If severe frost, waterlogging, or bad weather prevents us from lifting trees safely, dispatch may be delayed. If we cannot fulfill your order due to stock failure, we will notify you and issue a full refund.

3. Pricing & Payment

  • All prices listed on our website are in GBP (£) and include applicable UK taxes.

  • Delivery costs are calculated and displayed at checkout prior to order confirmation.

  • Payment must be made in full at the time of placing your order.

4. Delivery

  • Delivery will be made to the UK address provided during checkout. Please ensure your shipping details are correct; we cannot be held responsible for failed deliveries due to incorrect addresses.

  • You will be notified when your tree has been dispatched. Due to the perishable nature of bareroot stock, it is your responsibility to ensure someone is available to receive the parcel or that clear "leave in a safe place" instructions are provided.

  • Upon arrival, bareroot trees must be unpacked immediately and planted or heeled-in to keep the roots moist.

5. Cancellation, Returns & Growing Guarantee

Your purchase is subject to our Returns, Guarantee & Refunds Policy, which forms part of these Terms:

  • Statutory Rights: You have 14 days from receipt to cancel standard orders, except where the perishability rule applies.

  • Perishability Exception: Trees dispatched in early March cannot be returned after mid-March, as they become perishable beyond this point.

  • July 1st Growing Guarantee: We offer a guarantee until July 1st following purchase, provided the tree was planted correctly in adequate conditions (suitable soil, proper staking, shelter, and irrigation).

6. Limitation of Liability

  • To the maximum extent permitted by UK law, the total liability of Fife Fruit Trees for any claim arising out of an order or product failure is strictly limited to the replacement of the ordered item(s) or a refund of the price paid.

  • We accept no liability for indirect, consequential, or secondary losses, including but not limited to:

    • Customer labor or planting costs

    • Soil amendments, stakes, or compost purchased elsewhere

    • Loss of crop, yield, or enjoyment

  • We are not liable for tree failures caused by extreme weather events (e.g., severe unseasonal frosts, flooding, heatwaves), pest/animal damage, neglect, or poor planting practices.

7. Intellectual Property

All content on this website, including text, product descriptions, photography, logos, and design, is the property of Fife Fruit Trees and is protected by UK copyright laws. You may not reproduce or use any content without our prior written permission.

8. Governing Law

These Terms of Service and any contracts for the purchase of goods from Fife Fruit Trees shall be governed by and construed in accordance with the laws of Scotland (or the relevant laws of the United Kingdom), and any disputes will be subject to the exclusive jurisdiction of the UK courts.

9. Changes to Terms

We reserve the right to update or modify these Terms of Service at any time. Any changes will take effect immediately upon being published on this website.
